Terms of Use

These terms are an agreement between you and AI Generated Inc. (“we”, “us”) for your use of the AnyPic app and service. By using AnyPic, you agree to them. If you don't agree, don't use the app.

1. Eligibility

You must be at least 13 years old to use AnyPic. If you are under the age of majority where you live, you may use it only with a parent or guardian's permission, and purchases are subject to Apple's family and parental controls.

2. The service

AnyPic creates and edits images with AI models run by third-party providers. Results vary, can be inaccurate or unexpected, and may resemble content created for others. We may add, change or remove features, trends and models, and the service may occasionally be unavailable.

3. Your content

You keep your rights in the photos and text you submit. You give us and our providers permission to process them only to provide the service to you. You must own or have permission to use everything you submit, and you must have the consent of every person who appears in your photos. As between you and us, you may use the images you create for any lawful purpose; to the extent we have rights in them, we assign those rights to you. Images exported from AnyPic may be labeled as AI-generated.

4. Acceptable use

You may not use AnyPic to create, upload or share:

• any sexual content involving minors — we block it and report it to the authorities where required;
• nude or sexual imagery of a real person without their consent;
• content that harasses, threatens, defames, bullies or depicts violence against real people;
• deceptive images meant to impersonate someone, commit fraud or mislead people about real events;
• hateful or illegal content, or content that infringes someone else's intellectual property, privacy or publicity rights.

You also may not try to bypass safety filters, disrupt or reverse engineer the service, abuse credits or promotions, or access the service by automated means. We may block requests, remove credits obtained through abuse, or suspend access if you break these rules.

5. Credits, subscriptions and payments

• AI features use credits. Each feature shows its credit cost before you start. Credits are held when a job starts, charged only if it succeeds and refunded automatically if it fails.
• Credits are a limited, non-transferable license to use AI features. They have no cash value and can't be exchanged or refunded, except where the law requires.
• Credit packs and welcome credits don't expire while AnyPic is offered. Subscriptions add credits each month; unused subscription credits expire when the next month's credits are added.
• Purchases are made through Apple and billed to your Apple ID. Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours before the period ends. You can manage or cancel subscriptions in your Apple ID settings.
• Refunds are handled by Apple under its policies. If a purchase is refunded, we may remove the credits or plan benefits it provided.

6. Account deletion and termination

You can stop using AnyPic and delete your account at any time in the app. Deleting your account permanently removes your credits, history and generated images and doesn't cancel subscriptions. We may suspend or end access if you break these terms or if we stop offering the service.

7. Third-party services

AnyPic relies on Apple, Google (Firebase and optional sign-in with Google), fal.ai, Pexels and Cloudflare. Stock photos come from Pexels and are subject to the Pexels license. You are responsible for any data or carrier charges.

8. Disclaimers

AnyPic is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement, and we don't guarantee that results will be accurate, suitable or uninterrupted.

9. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost data or profits. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or USD 50. Nothing in these terms limits liability that can't be limited by law, or your rights as a consumer.

10. Apple App Store terms

• These terms are between you and us, not Apple. Apple is not responsible for AnyPic or its content.
• Apple has no obligation to provide maintenance or support for AnyPic.
• If AnyPic fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. Apple has no other warranty obligation for AnyPic.
• We, not Apple, are responsible for addressing claims relating to AnyPic, including product liability, legal or regulatory compliance, consumer protection and intellectual property infringement claims.
• You confirm that you are not in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

11. Governing law

These terms are governed by the laws that apply to AI Generated Inc., without regard to conflict-of-law rules. If you are a consumer, nothing in these terms takes away the protections of the mandatory laws of the country where you live.

12. Changes and contact

We may update these terms. We'll change the date above and, for material changes, tell you in the app; continuing to use AnyPic means you accept the updated terms. Questions: support@anypic.co.
